tammah Copyright Takedown – Counter Notice

A counter notification is a legal request for tammah to reinstate a video that has been removed for alleged copyright infringement. The process may only be pursued in instances where the upload was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled, such as fair use. It should not be pursued under any other circumstances.

Please note that when we forward the counter notice, it will include the full text of the counter notice, including any personal information you provide. The claimant may use this information to file a lawsuit against you in order to keep the content from being restored to tammah.

By submitting a counter notification, you consent to having your information revealed in this way. We will not forward the counter notification to any party other than the original claimant.

Counter notifications must be submitted by the video’s original uploader or an agent authorized to act on their behalf, such as an attorney.

The counter notification process can take 10 or more business days to complete once initiated, so please be patient. During this time, the claimant may file an action seeking a court order to keep the content down.

To submit a counter notification, please email us at copyright@tammah.com and include the following elements. Without this information, we will be unable to take action on your request:

  1. Your contact information

You’ll need to provide the following information that will allow us to contact you or a representative authorized to act on your behalf (such as an attorney) regarding your request. If you are an uploader’s authorized representative, please be sure to specify your relationship to the uploader in the counter notification.

  1. Full legal name (a first and last name, not a company name)
  2. Email address
  3. Physical address
  4. Telephone number
  1. Identification of the specific URL(s)

Please include the URL(s) of the exact video(s) or we will be unable to reinstate them.

Your counter notification must include specific links to the material that has been removed or disabled. General information about the video, such as a profile URL or username, is not adequate.

  1. You must agree to and include the following statement:

“I consent to the jurisdiction of the Federal District Court for the district in which my address is located, or if my address is outside of the United States, the judicial district in which tammah is located, and will accept service of process from the claimant.”

  1. And the following statement:

“I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.”

  1. Your signature

Complete counter notifications require your physical or electronic signature, or the signature of a representative authorized to act on your behalf, such as an attorney. To satisfy this requirement, you may type your full legal name (a first and last name, not a company name) to act as your signature at the bottom of your request.
